Court removes Jaarbeurs from Utrecht's zero-emission zone: municipality failed to research impact

The municipality of Utrecht has received a legal rebuke in its ambition to make the city centre cleaner. On 18 April 2026, the court of Midden-Nederland ruled that event complex Jaarbeurs and its main access roads — parts of the Graadt van Roggenweg and the Van Zijstweg — must temporarily remain outside Utrecht's zero-emission zone. The reason: the municipality failed to adequately investigate the consequences of the zone for the Jaarbeurs.


What is Utrecht's zero-emission zone?


Utrecht introduced its zero-emission zone for vans and trucks in 2025. New commercial vehicles have since been required to be zero-emission in order to access the city centre. A transition period applies to older vehicles: all vans must be emission-free by 2028, and all trucks by 2030. Thirteen Dutch cities have now introduced comparable zones.


The goal is twofold: cleaner air for residents and visitors, and an acceleration of the greening of urban logistics. Zero-emission zones are also one of the key drivers of demand for hydrogen vehicles in urban freight — and play a role in the broader hydrogen transition.


The Jaarbeurs under pressure


The event complex was located within the zone and feared significant economic damage. Unlike shops or theatres, the Jaarbeurs is entirely dependent on heavy freight traffic: every trade fair or conference requires a full logistics operation involving trucks, temporary installations and materials. That transport cannot simply be replaced by zero-emission alternatives when the required vehicles do not yet exist at scale.


The Jaarbeurs challenged the decision in court. The municipality argued that the Jaarbeurs is not an owner of vans or trucks and therefore not an interested party. The court rejected that reasoning: without deliveries, the Jaarbeurs cannot organise events — making it clearly an interested party.


Exemptions are not a substitute for research


The municipality suggested that any problems could be resolved through temporary exemptions. The court rejected that too. The core issue: the municipality has not investigated what the actual problems are. Without that understanding, it is impossible to assess whether exemptions would solve them. Consultation with sector organisations, the court found, was not sufficient — specific research into the Jaarbeurs' situation was required.


The result: the Jaarbeurs site and the access roads in question temporarily fall outside the zero-emission zone. The court has drawn a new map showing the revised boundary. If the municipality wishes to include the Jaarbeurs in the zone again, it must come forward with a new, better-substantiated decision. The municipality has six weeks to appeal.


What does this mean for the hydrogen transition?


The ruling is not an attack on zero-emission zones as a policy instrument. It is a lesson in due diligence: municipalities introducing zones must take the specific situation of each affected party seriously — especially for locations with exceptional logistical needs.


For the hydrogen market, the ruling has an indirect significance. Zero-emission zones are one of the most important drivers of demand for hydrogen vehicles in urban logistics. If municipalities are forced by legal setbacks to reduce or delay zones, that slows the business case for transport operators to invest in hydrogen trucks and vans.


At the same time, the ruling shows that the transition requires careful preparation — including from government. Locations like the Jaarbeurs need time to adapt their logistics, and that requires clarity, dialogue and realistic transition timelines. That lesson applies to all thirteen cities that currently have a zero-emission zone, and to the many more considering one in the years ahead.
